Aufenthaltstitel in Germany, guide for newcomers

The Aufenthaltstitel is your most important document in Germany, the legal permission to stay, work, study, and bring family. This guide covers all permit types, exact conditions, and points the Ausländerbehörde often does not mention.

What is an Aufenthaltstitel?

Aufenthaltstitel means long-term residence permission in Germany. It is a card (like a bank card, with chip) showing:

  • validity period
  • legal paragraph (§ 16b, § 18g, ...)
  • conditions (work permission, hours, ...)
  • your biometrics

You get it from your city's Ausländerbehörde (in Berlin: LEA, Landesamt für Einwanderung).

Types of Aufenthaltstitel

§ 16b, Studium (study)

  • For: Bachelor, Master, PhD students
  • Duration: 1 to 2 years, renewable
  • Requirements: university admission, Sperrkonto ~11,208 euros (2025, one year), insurance, Anmeldung
  • Work: 140 full / 280 half days per year
  • Conversion: after graduation → § 20 (job search, 18 months)

§ 18b / § 18c, Fachkraft (skilled worker)

  • For: people with recognized degree and employment contract
  • Requirements: recognized qualification, contract, appropriate salary
  • Work: only for specified job; job change must be reported
  • Duration: usually 2 to 4 years, renewable
  • For: university graduates with high gross income
  • Minimum salary 2025:
    • General fields: 48,300 euros gross/year
    • Shortage fields (IT, engineering, medicine, math, natural sciences): 43,920 euros
  • Major benefits:
    • Fast Niederlassungserlaubnis: 33 months (with A1) or 21 months (with B1)
    • Free job change after 2 years
    • Spouse without A1 German
    • Schengen travel
  • Duration: up to 4 years (or contract length + 3 months)

§ 21, Selbständige (self-employed)

  • For: founders, freelancers, artists
  • Requirements: viable business plan, financial proof, regional economic benefit
  • For freelancers (§ 21 Abs. 5): clients, portfolio, sufficient income
  • Duration: 3 years, then Niederlassungserlaubnis if successful

§ 28 / § 30 / § 32, Familienzusammenführung (family)

  • § 28: joining German spouse
  • § 30: joining foreign spouse with residence
  • § 32: children under 18
  • Requirements: suitable housing, sufficient income, A1 German for spouse (exception: Blue Card, skilled worker)

§ 9, Niederlassungserlaubnis (permanent residence)

  • Unlimited, no job or location restriction
  • General: 5 years legal residence, B1 German, 60 months pension contributions, suitable housing, no criminal record

§ 9a, Daueraufenthalt-EU

  • Similar to § 9 but valid EU-wide
  • Similar conditions, more complex process

Renewal step by step

1. Timing

CityHow many months before?
Berlin (LEA)6 months before expiry
Hamburg, Munich, Cologne, Frankfurt3 to 4 months
Smaller cities (Cottbus, Münster, ...)2 to 3 months

2. General documents for renewal

  1. Valid passport (at least 6 months validity)
  2. Current Aufenthaltstitel
  3. Meldebescheinigung (current Anmeldung)
  4. Krankenkasse, proof of active insurance
  5. Income proof:
    • Employee: contract + 3 months payslips
    • Student: Immatrikulationsbescheinigung + Sperrkonto or Verpflichtungserklärung
    • Freelancer: BWA, previous year Steuerbescheid
  6. Lease + copy of Wohnungsgeberbestätigung
  7. 2 biometric photos (at Drogerie or dm)
  8. Fee: usually 93 to 100 euros

3. Book appointment

Your city's Ausländerbehörde website:

  • Berlin: service.berlin.de → "Verlängerung Aufenthaltstitel"
  • Other cities: [city].de/auslaenderbehoerde

If no slot: email with subject "Verlängerungstermin, Aufenthaltstitel läuft am [datum] ab". Reply usually within 10 days.

4. If permit expires and no appointment

This is common and not instantly catastrophic:

  • Keep screenshots of booking attempts
  • Email Ausländerbehörde before expiry
  • Request "Fiktionsbescheinigung", extends residence until decision

5. At the appointment

  • Documents ordered in a folder
  • Arrive 10 minutes early
  • If German is hard: "Können Sie das bitte einfacher sagen?" or "Auf Englisch, bitte"
  • Outcome: new card on site or Fiktionsbescheinigung + card in 4 to 6 weeks by post

Critical points for newcomers from Iran

1. Student to Blue Card conversion, optimal path

After graduating in Germany with Blue Card salary: go directly to § 18g (not § 18b). Reasons:

  • Niederlassungserlaubnis in 21 months (not 5 years)
  • Faster job mobility
  • Spouse without A1

2. Sperrkonto for students

For student visa:

  • 2025: 11,208 euros for one year (~934 euros/month free)
  • Providers: Expatrio, Fintiba, Coracle
  • Fintiba and Expatrio: good rates, sometimes Persian support
  • Important: open Sperrkonto before visa in home country, consulate requires it

3. Dual citizenship, 2024 law

Since June 2024 Germany allows dual citizenship. You do not lose Iranian citizenship when naturalizing. But:

  • Report to Iranian embassy
  • Enter Iran with Iranian passport (not German)
  • Consular services become limited

4. Translating Iranian documents

Most Iranian documents (birth certificate, marriage certificate, degree) need a sworn translator in Germany. Official list: justiz-uebersetzer.de.

Cost: about 40 to 80 euros per page. Embassy/consulate translation from Iran not accepted.

5. Emergency travel to Iran

If permit is expiring or renewing and you must travel urgently:

  • Get Fiktionsbescheinigung first
  • Without it, problems on return at German airport
  • Bring Ausländerbehörde documents

6. If you lose your job

  • Immediately inform Ausländerbehörde (legal duty)
  • 3 to 6 months to find new work
  • Possibly Arbeitslosengeld in this period
  • With Blue Card: convert to § 20 (job search) possible

Tax and pension (important for Niederlassungserlaubnis)

For permanent residence (§ 9) you need at least 60 months Rentenversicherung paid. Automatic from salary if employed. For freelancers voluntary, minimum contribution recommended for later permanent residence.

Checklist

  • Identify current Aufenthaltstitel type (§ on card)
  • Put expiry date in calendar with 6-month reminder
  • Keep base documents ready: Meldebescheinigung, insurance, payslips
  • With Blue Card: note 21/33 month date for Niederlassungserlaubnis
  • For renewal: book at least 3 months ahead
  • Never let permit expire silently, email Ausländerbehörde before expiry
  • Translate Iranian documents before needed (once, keep in folder)

Q & A

Frequently asked

What is the difference between Visum and Aufenthaltstitel?

Visum allows entry to Germany and is issued at the consulate (usually 3 or 6 months). Aufenthaltstitel is the long-term residence permit inside Germany from the Ausländerbehörde. After entry you must convert the Visum to an Aufenthaltstitel.

How early should I apply for renewal?

At least 3 months before expiry, 4 to 6 months in big cities. Appointments in Berlin often take 6 to 8 weeks. If your permit expires but you have an appointment, you get a Fiktionsbescheinigung extending validity until the decision.

What happens if I change jobs?

With Blue Card: in the first 2 years inform the Ausländerbehörde, sometimes new approval needed. After 2 years you are free. With §18: job change needs new approval. With §16 (student): up to 20 hours/week free, more needs permission.

When am I eligible for Niederlassungserlaubnis?

General: 5 years legal residence + B1 + employment + pension contributions + no criminal record. Blue Card: 33 months (with A1) or 21 months (with B1). German university graduates: 2 years work after graduation.

Is my permit revoked if I become unemployed?

Depends on visa type. Blue Card and §18: up to 3 months unemployment, active job search required. Student: until end of studies. Niederlassungserlaubnis: unlimited, as it is permanent.

Can I bring spouse and children?

Yes, Familienzusammenführung (§ 28, § 30, § 32). Requirements: adequate apartment (~12 m² per adult), sufficient income, insurance for all. Spouse needs A1 German (exception: Blue Card).

Can I work on a student Aufenthaltstitel?

Yes, up to 140 full or 280 half days per year (or 20 hours/week during term). No limit for university jobs (Hilfskraft, tutor).

When do I get German citizenship?

General: 5 years legal residence + B1 + test, or 3 years with strong integration (C1 + volunteering + formal job). New 2024 law allows dual citizenship, you keep Iranian citizenship.
